The APD Suite Terms of Service

Disclaimer:

The APD Suite is a battery of tests designed to be carried out by a qualified clinician to assess auditory processing abilities in children (and adults). The results from the tests should be considered in relation to other medical information available to the clinician. The results must not be considered in isolation as medical advice.

The APD Suite tests must be carried out in a quiet environment where the client can give their full attention to the test activities. Headphones are required. We will collect, store, use and disclose personal information obtained through use of The APD Suite in accordance with our privacy policy at www.soundscouts.com/au/about-company/privacypolicy/

The results from The APD Suite may vary, depending on whether you (the clinician) and the client are in a quiet or noisy environment, whether the client has understood what they are supposed to do and depending on the client's ability to concentrate during the test activities.

You should not rely alone upon the results of the Sound Scouts APD Suite tests as a basis for determining the client’s auditory processing abilities. Any reliance placed on the results of the APD Suite tests is entirely at your own risk and that of the client.

To the fullest extent permitted by law, we are not liable to you or any third party, (whether under the law of contract, the law of torts expressly including negligence, or otherwise) in relation to the contents of, or use of, or otherwise in connection with, the Sound Scouts APD Suite for any direct, indirect, special or consequential loss, including personal injury, arising out of or in connection with the use by you or the client of the Sound Scouts APD Suite and in particular, any errors or omissions in the Sound Scouts APD Suite which may lead to expense, injury, loss or damage to you or your child.

You agree that Sound Scouts can use the results/data from any tests you carry out, in de-identified form, for research purposes.

In addition to the above::

  • - (i) You have no right to access or use the APD Suite in source code form;
  • - (ii) You must not remove or obscure any copyright or proprietary notices on the APD Suite;
  • - (iii) all right, title and interest (including without limitation intellectual property rights) of the APD Suite remains with Sound Scouts Pty Ltd and its licensor (that is, Macquarie University);
  • - (iv) You must not copy the APD Suite, remove the APD Suite from the product on which it was installed, reverse engineer, decompile, disassemble, or derive source code from the APD Suite, publish, distribute, rent, lease, sell, sublicense, assign, translate,, merge, adapt, reproduce, make error corrections, vary, alter or modify, the whole or any part of the APD Suite nor permit the APD Suite or any part of it to be combined with, or become incorporated in, any other programs.

These disclaimers shall be governed and construed by the laws of New South Wales, Australia.
